
Changes to Terms of Use for existing customers of OpenPayd – what you need to know

We are changing our Terms of Use, Data Processing Agreement, Privacy Notice and the Information Security Statement which form part of our Terms of Use to meet business, industry standards and applicable legal and regulatory requirements. Please keep reading to understand the key changes and how they will affect your use of the OpenPayd services.
As part of this update, we have also made changes to improve clarity and consistency.
Key Changes to the Term of Use:
- We have included additional detail on the safeguarding arrangements for client funds, including the potential use of insurance where permitted by law.
- We have clarified how any reserve or float requirement may be applied and such funds held, including when such funds are safeguarded and when they are not.
- We have included a new provision explaining that, if your fees account or the OpenPayd Account on which the transaction occurred does not have sufficient funds, we may deduct the fees from your other OpenPayd Accounts, either in the same currency as the fees owed or, where necessary, in an equivalent amount in a different currency using our market exchange rate.
- We are able to terminate the agreement by providing three months’ notice to you, unless the corporate opt-out applies.
- We have clarified that certain information may be shared with banking partners and other providers involved in delivering the services, as well as with complainants, regulators or other third parties in connection with the handling of complaints or disputes.
Changes to the Data Processing Agreement and Privacy Notice:
- To make onboarding and access to additional services as smooth as possible, the Data Processing Agreement now includes a general authorisation for sharing relevant personal data with our affiliated group entities when you request new services.
- We have expanded our Privacy Notice to give you better visibility of the personal data we process about your representatives and end users and to help you explain OpenPayd’s role and data processing activities to them where needed.
Changes to Information Security Statement:
- We have refreshed our Information Security Statement to reflect the strengthened technical and organisational measures we have put in place in connection with our ISO certification.
